They have high quality merchandise pens, notebooks, things like that and they're really inexpensive. I highly recommend them-National Pen Company. Worst case scenario is if you get on their mailing list, every two weeks they will send you a sample product in the mail. I just got like a notebook in the mail from them. Its actually branded with my firm's information on it, and I get something every two weeks.

Ryan’s Tip: If you can at all buy noise canceling headphones, they will help you be way more productive. We like Bose noise-canceling headphones.

 

Reach out if you need help. Many lawyers are afraid to get help when they are suffering. You are not alone.

 

Bill’s Tip: In this age of personal connection, it is important to do a lot of videos. Toss out your old videos that aren’t good anymore.

Get a video coach to shoot better videos.

Self confidence is the number one variable for all performers. What that perfectionist mentality does, is it really takes its toll on a person self confidence. If I keep thinking about that error or that missed opportunity, and not focusing also on the things I’ve done well, my confidence is gonna take a beating. We try to train people to develop the performance mentality, that it’s about recognizing what you have done well and relentlessly improving.

 

“Highly successful people NEVER get anything done in one given day, but what they do is, ALWAYS get their most important activities done each and every day.”

 

Plateaus in business

“Plateaus will happen. There will be times where you’re kind of in that phase of doing the work and not seeing the immediate results, but if you stay with it: 30, 60, 90 days, nailing your one most important and usually getting the 3 most important done each day, you are probably gonna find plateaus don’t last very long; that you find ways to keep moving it to the next level.”

 

The mindset of saying no

The first step to saying no is evaluating where your time and energy are going, and in terms or relevance, what’s most important? If right now you are feeling overwhelmed, the next step is to eliminate 10% to 20% of what you are currently doing. The third step, is moving forward. The next time anyone ask you something, before saying yes, identify what will you say no to.

Don’t overload yourself. Prioritize.

Established law firms already have technology that they’ve been using or a series of processes and they are hesitant to move away from what the are used to. Change is hard, but delaying the move to adapt a new system is going to hurt you, because clients expectations are always changing.

As many of solo practicing lawyers, Randall has the “good” struggle of not having enough time to do everything. He’s in a point in which he may need to add an associate or an assistant. He’s having trouble letting things go that he SHOULD let go.

Every client is not created equally and there are some clients who really aren’t worth 5 times what your normal fee would be.

You can’t bill for waking up on the middle of the night. You can't bill for sitting in front of your computer willing to smash your keyboard because someone isn't listening to you.

They’re just not worth it.

So, how do you identify those clients? With experience. When somebody calls you and something just doesn’t feels right about what they said, or something about how they’re talking to you just doesn’t feel right, something doesn’t line up; just go with your gut.

“I have a great case!”... No you don’t!

Bad clients can crowd out good clients, they leave you without energy to deal with new clients or with actual good clients. Re-allocate your resources from all the bad places to good places.

Nowadays, Marketing can be found in so many forms and be applied in so many ways that it is really important to have some criteria and pick the things and strategies that really make sense from a marketing standpoint.

1. Sometimes you are already doing enough and the thing that you are doing have a lot of potential to grow. You need to do deeper, not broader. Stick to what you are good at and what’s working
You are already doing plenty, just keep going with that, don’t add something new to the mix.

2. You ought to pass on a marketing tactic if you don’t understand it.
Do not put money on the line for things you don’t understand.

3. Feel it in your guts. If you feel a tactic it’s not for you, then it’s not for you. DON’T DO IT.
You ought to be excited and energized about any marketing idea you are considering.

4. Don’t do the marketing tactic because somebody else is doing it.
Pick your own tactic, the one that works for you.

5. Don’t do things that don’t work.
If you are being pitched on a tactic and there is no evidence that it works, don’t believe it works just because this company is still pitching it to you. Get references, real life lawyers. Don’t buy it unless the vendor can prove to you that it actually works.

6. You don’t trust the vendor: STAY AWAY.
Trust your instincts.

7. Commitment. There is no reason in the world we live in today, to sign a 1, 2 or 3 year deal.
The things that today work best for us, involve no commitment.

8. Ethics. Beware of unethical tactics.

9. Expensive tactic. Today, we can market our practices on a small budget.

Once you figured out what the value of a client is for one case, then the next step is to figure out how can you increase the number of transactions you do with this client and how can you orchestrate referrals down the road and transform 1 client into 5. In other words, increase the lifetime value of this client. Therefore you are going to be willing to spend more money to get those leads.

Follow up! If you take that extra step and you create things and stay in touch with your former clients, that makes a big difference.

If you just market to the people who are already in your tribe, it is cheaper and more effective.

The more competitive your legal area is, the more important it is to have a greater quantity and quality of content (It doesn’t cost anything!). A good way to create content is to write down the questions people make you and answer them to all the ones having that same question.  
You can do videos, podcasts, or even keep it simple and just do a blog. Just keep track of your topics and put a simple system in place.

There is definitely some internal strength that you are going to need in order to be able to soldier through when things get tough and there are ups and downs to practice.

Sometimes you feel the risk is greater than the opportunity.

Description: You answer your own phone. It telegraphs to potential clients that you’re really not that busy. It telegraphs that you don’t have enough business going on to be able to support someone answering your phone.   It demonstrates you are sort of desperate for the call. It keeps you from doing good work. It distracts you. It is a lack of time management. Clients are expecting a receptionist. It’s more professional. You have a non professional email account. You need to look professional. Be professional. You meet with potential clients at Starbucks or Panera. It telegraphs you are small potatoes, and that you don’t make enough money to spend money on an office, or you don’t care enough. You need an office. Because of what it represents, because of the privacy. You lower your fee when pressured by a potential client. Set a fee which is fair to you and fair to your client. You don’t wanna be dealing with client who are looking for the lowest cost denominator. It telegraphs to clients that we as lawyers will fold to others when dealing with another attorney or the government. It sets the tone for the relationship. Clients could end up bossing you around. People are smart, they are gonna try to get the best deal possible. You offer many practice areas in your website. This telegraphs that you will do anything. It shows you don’t have the systems nor the expertise built out to handle a particular matter. How can you target with so many practice areas!?
 

Hacking’s Hack: Don’t work at home, work in the office. Stop looking at your phone, emails, to-dos, etc once you get out of the office. This will give you time to be with yourself and your family. Read books. Spend quality time with your kids.

It’s gonna telegraph that you feel shaky about what it is what you do. Be confident on your skills. Use your reputation as your favor. Don’t seem desperate. Don’t lower your fees.

The tactician and the entrepreneur. The two sides of the business. One gets the clients, and the other works on the clients. In other words, both faces depend on each other. You should never focus on only one of them. Bring in the clients you want and need, but make sure to be able to work on them. Bringing in clients is very important, but If you can’t be efficient with the clients you already have then you have a problem. It’s time to grow.

 

Organize yourself. Eliminate, automate, and delegate. Maximize your time.

When you are building and starting out you are less busy. It’s a good idea to use the time you have to build the systems to keep track of your clients and provide them a good service, so when the time comes you are already systematized.

When you see something in another industry, instead of having a closed mindset,look at it, play around with it and see how you can internalize it and make it something you can use in your own practice.

Learn from other industries, look for ideas to make you practice grow. There are many ways of doing it. Mastermind, Podcasts, Magazines.

Take advantage from actual technologies, social networks, events, webinars, seminars. Improvise, try new things. There’s just an unlimited list of ideas you can get from other industries, and all you have to do is think about how you can apply it to your practice area. If you can, use it. If you can’t, then don’t use it. Simple.

He was trying to conquer Mexico with only 600 men, and when he got there and saw how huge the enemy was he realized that the only way they were going to do such thing was if his army knew that there was no way back, no turning back. So he burnt the boats. He is the first person to conquer Mexico.

Commitment. Commit to your firm. Running and building your own law firm is hard, so if you’re going to be half in, in the long run you’ll do yourself and your client a disservice. If you are not committed to building a well oiled machine that functions properly and that all the things that a healthy law firm needs to do, you can’t double in this, you can’t be half in.

If you don’t have work to do, you need to be generating work. It is not OK to stay at home half of the day because you don’t have any work.  Work hard, get clients. Hussle.

The before unit: before you get the client.

The during unit: your representation of the client.

The after unit: after you handled the case.

There are lots of people walking around who may need your services. Your job is to identify those people and find where they gather.

Nich down (we already talked about this in a previous episode). Narrow down the nich. Pick the target.

Clients need their problem solved. So if you advertise with a lot of practices, the ones that the client don’t need will act as noise and will distract. Your message needs to be clear. From a practical standpoint, if you do the things you can do and are good at, your clients will be happy and will go out and tell other people about you.  Create an effective add, a compellent offer.

If you give referrals you will end up gaining. Refer clients you can’t handle to other lawyers and make efforts to have them call somebody else that you know does that practice. And make sure that attorney knows that client comes from you, so they’ll know they’re getting something from you. This is very valuable. When you give a referral, explain why you are connecting them.

When you refer - or, before you refer-, you are pre qualifying the person before they even contact the lawyer, and you are helping the lawyer and the client. Be that guy that everyone goes to: Be “The Hub”, so you can start dishing up the cases and definitely grow your network.

Tyson’s Tip: https://hootsuite.com/. An app that allows you to schedule up all of your social media network posts.Very easy to use and it saves a lot of time.

Be careful of how many posts you schedule and when you do it. A lot of scheduled posts loose the “original and live” feel of a content. There are some kind of posts that work great with an auto schedule, others don’t.

What’s the most important part of being an attorney? Get the clients to the door. 

Develop business and bring business. Quickbooks, payroll, hiring… Lots of skills you'll need to learn if you are going to have staff. And if you won’t learn them, they should be taken care of by an assistant.

Hiring staff: are you good at it?

A connected world has it’s advantages, you can outsource stuff virtually. Delegation: take the things that you shouldn’t be doing and give it to the people that should be doing them. Very key to run a successful law firm.

You can’t do more than 2 very well and you can’t market more than 2 very well. Niching down makes your marketing and processes easier, it makes you more efficient.

Referral network. You can feed it and it can feed you right back (clientwise). Other lawyers who work on other practice areas refer you and you refer them.   

Fact: Look around and see the most successful lawyers in the country, you’ll notice they do 1 thing or 2. If you have 12 practice areas in your website, it may look better but your message is garbled.  

Get the client to the door, then you can be the best lawyer, but to be the best lawyer you must know and master your practice areas. If you focus on many you will never be a good lawyer.

As you hire more people, there are more people that are dependant of you. Sometimes this consumes your time and your energy. Don't become a bottleneck in your firm.

Keep track of what it is that needs to get done. Make a list and then figure out who's the best to do it. This will give you more space and time to you to make the things YOU need to do.

KPI: Key Performance Indicators: Things that you can identify, you can look at, that give an idea of what the direction of your firm is. For example: new clients, new leads. If you have your KPI’s in place you can correctly determine whether to hire or not a new employee or which decisions should be made. Put plans in place and follow through.

Hiring employees is difficult and expensive. Not financially but everything else> the time assisting, developing and growing them.

Sometimes, hiring a non experienced employee is better. They don’t have preconceived notions coming to the office and you can train them the way you need.
